David Lange's 2004 Whois registration for Israellycool.com

Aussie Dave is David H. Lange.  Now, there I’ve said it.  It’s been a long time coming, Dave.  I hope you’re ready for your closeup.  Dave was proud that he snared me in a trap he set inducing me to report a fake identity that he’d devised.  What he didn’t bargain for was that someone (not me) would be so offended by his shenanigans that he outed him.  So here’s what I know: his home address and phone, his wife’s name, her website.  I’ve seen pictures of him, his wife, his kids.  I know where his parents live/d in Australia.  But all that doesn’t matter and I’m not going to publish it.  Just to ensure that I do know this information, I’ll confirm that he lives in the Givat Sharett neighborhood of Beit Shemesh.  I’ve displayed his photo because he displays several of me without my permission.  I should add that years ago when he complained that I displayed a photo of him in which he was masked, I removed it.

Dave’s Facebook account was until very recently publicly accessible.  Appears to be no longer.  Wonder what Lange was afraid of.  So do be careful, Dave and follow the TOS in future or we’ll be able to tell Facebook who you really are and what your real FB account is.

Lange claims I’ve endangered his family by seeking to publish his home address.  But that’s really self-pitying nonsense.  He omits the fact that my address, phone, wife’s employer and work phone are published explicitly at his site.  Dave doesn’t believe in the old saying: “Do unto others as you would have them do unto you.”  Dave thinks it’s cool to out his enemies but he squeals like a pig when someone does it to him.

The information used to find him is all in the public domain.  No others forms of investigation were used than Google and the internet.  Dave and his supporters may be tempted to dream up some twisted form of revenge.  I’m holding information in abeyance to tame their passions.

As my post written earlier today confirms, Lange and Dave Brotsky of JIDF have engaged in a massive hasbara effort to infiltrate Palestinian Facebook groups and goad members into pro-terror statements which could be used to close down the groups.  This is an overt violation of Facebook Terms of Service.  I think what Lange needs is a big dose of transparency and honesty to make him realize that he can’t stand behind his former opacity and anonymity.  People now know who he is.  If he continues breaking rules and acting the role of agent provocateur, at least we now know who to blame and can  put a name and face to his misdeeds.

David Appletree exposes Aussie Dave's 'fake' Facebook accounts

I’ve come into possession of a series of tweets from 2010 and shared among Aussie Dave, the Jewish Internet Task Force’s (JIDF) David Appletree (the nom de guerre of David Brotsky) and other members of the hasbara jihad brigade.  They document a coordinated project to forge Facebook accounts and identities in order to amplify their pro-Israel efforts among the social networking community.  Among the activities in which they’ve engaged, more recently are the creation of the “David Loeb” Facebook profile which Aussie Dave used as a hoax identity.  Aussie Dave also reveals that he’s used a fake ID in order to infiltrate this pro-Palestinian Facebook group.  Once accepted, he posts incendiary pro-terror comments seeking to bait other members into escalating the conversation.  Such provocations can then be used by the hasbara activists to discredit the cause and general and get groups taken down.

Aussie Dave blames JIDF for exposing fake FB account

JIDF exposes one of Aussie Dave's fake Facebook accounts, "Dave Israel," which FB cancelled

This is precisely the sort of manipulation of online discourse which poisons the well and degrades the value of Facebook and similar sites.  It’s why it’s important to police their activity and bring it to Facebook’s attention and to insist that Facebook better police its own site and pages.  Of course, these activities violate the site’s Terms of Service and one tweet in particular finds Aussie Dave saying this explicitly.  In another tweet, the latter remonstrates with the JIDF major domo for “outing” one of his fake IDs, “Dave Israel,” and endangering his entire web of fake accounts.

I would urge groups administered by Palestinian or peace activists to maintain vigilance for this sort of behavior and to insist that individuals who appear to be provocateurs provide evidence of their bona fides.  I’m sure many are already doing this.  But this new evidence shows the need for constant vigilance.

aussie dave's infiltration of facebook groups

Aussie Dave documents infiltration of Palestinian FB groups

This also indicates the absolute bankruptcy of the hasbara project.  Instead of engaging in substantive activity dealing with real issues and political debate, these knuckleheads spends countless hours engaged in subterfuge and deception seeking to sabotage the “enemy” rather than advancing anything constructive or of real value on behalf of Israel.  What does it say about the hasbara apparatus as a whole and the entire pro-Israel movement that it would countenance such lying and cheating.  Is a cause worth anything if its worst adherents can justify such behavior.

I should make clear that there is nothing wrong with supporting Israel in whatever fashion one chooses as long as one does so transparently, candidly and forthrightly.  What Aussie Dave and JIDF do should be treif for anyone who supports Israel.

The Sad Case of Aussie Dave

Thursday, December 29th, 2011

UPDATE: Sometime after Aussie Dave/David Lange published a post bragging about the fake identity he’d created and the hoax he’d perpetrated on me, an ace researcher uncovered Lange’s real identity which I posted about here.

Yesterday, I reported in a post that I believed I had exposed the real identity of Aussie Dave, author of the Israellycool blog.  It appears that he invented a fake identity in order to perpetrate a hoax on me.  It boggles the mind that he went to the immense amount of trouble he did to perpetrate this hoax.  It tells you how much free time he has on his hands to engage in all the subterfuge that was necessary to fool me.  It tells you precious little about me, but quite a lot about him.

Dave thinks he’s a genius because I fooled me.  What he doesn’t realize is that in his blog post, he proudly admits that he created a hoax Facebook account for a non-existent person using the photo of a real person, a clear violation of Facebook rules.  Here’s how he bragged about it:

David Loeb is a fake name. The photo in the Facebook profile I set up is of basketballer Jordan Farmar…I used his photo deliberately…

I included in the profile my supposed address (Beit Shemesh)…as well as the URL of this blog to connect David Loeb to it.

I’ve reported him to Facebook for doing this.  I hope there will be repercussions and that he doesn’t have a real Facebook account.  If he does, perhaps Facebook will express its displeasure with idiots like him exploiting company for his own tomfoolish purposes.

Dave moans in his post that I not only violated his privacy by posting what he wanted me to believe was his home address, but that I potentially endangered him.  Which is funny because he doesn’t mention that he not only published my home address and phone number, but my wife’s employer and her work phone.  UPDATE: He’s now claiming that commenters at his site published links to my private information, which is also a lie since the actual information (not links) is still there as clear as day.  I have a screenshot and know the link as well but prefer not allowing others to access it freely.  He also lied when he claimed that he hadn’t pubished the information.  Blogger have the ability to publish or not publish comments.  We all make those choices.  When someone writes a comment and you publish it, you’ve taken responsibility for doing so.  Except if you’re Aussie Dave, then you haven’t taken responsibility for anything.

He and his allies are trying to embarrass Jillian York, a staffer at the Electronic Frontier Foundation, who correctly warned me that his Facebook account appeared to be fake.  They’re claiming that I exposed the private details of an individual in violation of EFF guidelines and that York is somehow guilty of violating her employer’s mission statement calling for protection of the privacy of bloggers.  This is yet more nonsense since Aussie Dave created a publicly accessible Facebook account to which anyone had access and which displayed his alleged address for anyone to see.  Not only that, but the account is fake as is virtually all the information in it.

Dave of course doesn’t mention the recent incident when he hoaxed himself, seeking to believe that my brother had been arrested for being a welfare cheat.  The only truth to his fantasy was that someone with my extremely common last name had been arrested for such a crime.  He created an entire post in which he gleefully, hopefully speculated that the perpetrator might be my brother.  He even searched through my online photo galleries, finding a photo of my brother-in-law and speculating that because he had the same first name as the welfare cheat that they might be the same person.  They weren’t.  Not a word from Dave about this violation of the privacy of my brother-in-law, a totally innocent party in his charade.

There’s a larger point here as far as I’m concerned.  It’s that doing what I do is complicated because I have to trust my sources and go with my gut about their credibility.  Yes, I can do some elementary research to determine their credibility.  But in the end, you have to decide whether or not to take a jump.  Usually, the times when I’ve been hoaxed are when I decide to trust people I’ve never dealt with before and whose bona fides aren’t clear.  That’s what happened in this case.

I’ve said before that I’ve made mistakes in trusting a few hoaxsters (luckily only two as far as I know).  Luckily those mistakes have been few.  Now we can add this one to the previous ones.  When you report stories that I do, there is always the chance that you will make mistakes.  Some will involve discrete points in an overall story.  Others will be larger and more serious errors.  I’ve never claimed to be perfect.  In fact, I think conceding mistakes shows readers that you are human and have nothing to hide.

Dave wrote in his post that he believed I would take down my earlier post exposing him because I would be embarrassed.  Not at all and I certainly won’t.  Both because I want readers to know that I’m transparent; and because I want people to see what he has done and judge him for it.  I want people to understand the pains that the pro-Israel Islamophobic blog world takes to smear its opponents.  And the nastiness of their methods and outcomes.  Aussie Dave now has the distinction of being the James O’Keefe of the pro-Israel Islamophobic blog world.  He and all his supporters may be proud of his methods of lying and deception.

Australian Labor Victorious, Bush-Supporter Howard Goes Down to Defeat

Saturday, November 24th, 2007
john howard vikingJohn Howard celebrating his pre-historic Viking roots (Fairfax archive)

I don’t usually write about Australian politics here. But in the course of writing this blog and other online posting I’ve become friends with Sol Salbe, a Melbourne Israeli-Australian peace activist and Violet Crumble, my partner in Israel Palestine Forum. I’ve also had a long-running distaste for another Australian-Israeli blogger with the mysterious name of Aussie Dave (Dave L.).

So it gives me great pleasure to announce that the Australian Liberal (conservative) Party has taken a drubbing and lost power after eleven years to the Labor Party. Not only this, for the first time since 1929 a sitting PM has lost his own seat. Howard is not only out of power he’s out of parliament. What a loss! Doubtless one of his moneyed friends will step forward to find something useful (or useless depending on your point of view) for him to do.

This means that Australia will join the Kyoto Protocol (leaving one less supporter of the U.S. rejectionist position) and withdraw from Iraq. George Bush’s most slavish supporter in the Pacific Rim is now gone into forced retirement. I would also hope that John Howard’s harsh anti-immigrant position might be at least slightly modified by the new government. By 2008, Prime Minister Rudd should have a new Democratic partner in the White House.

Sol and Violet–savor the victory. Aussie Dave, Liberal Party sycophant, you must be crying in your Foster’s over this one. We’ll really savor triumph for you. Better luck next time. Oh and Dave, at this rate if you write as fawningly about the U.S. Republicans as you have about the Libs you’ll prove the kiss of death to them as well in 2008. Not that they really need your help to lose. Your buddy George Bush is doing that for them.

Gideon Levy: ‘IDF an Army That Kills Children’

Sunday, September 2nd, 2007

Aussie Dave (isn’t it churlish, Dave not to link to my blog when I’ve linked to yours; and isn’t the ‘anti-Israel’ calumny a bit tiresome by now??) and his allies commenting here are up in arms over my post about the three Palestinian children killed by the IDF. And I’m a VERY BAD Jew for allegedly caring only about Palestinian lives, and not Israeli. Hey, go ahead take your best shot. But then spend a few minutes reading what one of Israel’s best journalists has to say on the same subject. How do you defame Gideon Levy? How do you belittle his commitment to Israel? How do you frame him as a Palestinian dupe?

I don’t usually post all or even large portions of articles. But in this case, I want everyone (especially those who have attacked me) to read this because it’s important:

Again children. Five children killed in Gaza in eight days. The public indifference to their killing – the last three, for example, were accorded only a short item on the margins of page 11 in Yedioth Ahronoth, a sickening matter in itself – cannot blur the fact that the IDF is waging a war against children. A year ago, a fifth of those killed in the “Summer Rain” operation in Gaza were children; during the past two weeks, they comprised a quarter of the 21 killed. If, heaven forbid, children are hurt in Sderot, we will have to remember this before we begin raising hell.

The IDF explains that the Palestinians make a practice of sending children to collect the Qassam launchers. However, in this case, the children killed were not collecting launchers. The first two were killed while collecting carob fruit and the next three – according to the IDF’s own investigation – were playing tag. But even if we accept the IDF’s claim that there is a general trend of sending children to collect launchers (which has not been proven), that should have brought about an immediate halt to firing at launcher collectors.

But the IDF does not care whether its victims are liable to be children. The fact is that it shoots at figures it considers suspicious, with full knowledge – according to its own contention – that they are liable to be children. Therefore, an IDF that fires at launcher collectors is an army that kills children, without any intention of preventing this. This then is not a series of unfortunate mistakes, as it is being portrayed, but rather reflects the army’s contempt for the lives of Palestinian children and its terrifying indifference to their fate.

A society that holds ethical considerations in high regard would at least ask itself: Is it permissible to shoot at anyone who is approaching the launchers, even if we know that some of these people may be small children, lacking in judgment, and thus not punishable? Or are we lifting all restraints on our war operations? Even if we accept the IDF’s claims that its sophisticated vision devices do not enable them to distinguish between a 10-year-old boy and an adult, the IDF cannot evade its responsibility for this criminal action. Even if we assumed a completely distorted assumption that anyone who goes near the launchers is subject to death, the fact that children are involved should have changed the rules. Add to this the fact that the firing at launcher collectors has halted the Qassams, or even reduce their number, and you arrive at another chilling conclusion: The IDF shoots at children to wreak vengeance and punish.

No child in Sderot is more secure as a result of this killing. On the contrary.

Anyone who takes an honest look at the progression of events during the past two months will discover that the Qassams have a context: They are almost always fired after an IDF assassination operation, and there have been many of these. The question of who started it is not a childish question in this context. The IDF has returned to liquidations, and in a big way. And in their wake there has been an increase in Qassam firings.

That is the truth, and they are hiding it from us. When Gabi Ashkenazi and Ehud Barak assumed their positions, the reins were loosened. If Barak were a representative of the political right, perhaps a public outcry would have already been sounded against the IDF’s wild actions in Gaza. But everything is permitted to Barak, and even the fact that the victims are children does not matter – not to him and not to the Israeli public.

Yes, the children of Gaza gather around the Qassams. It is practically the only diversion they have in their lives. It is their amusement park. Those who arrogantly preach to their parents “to watch over them” have never visited Beit Hanoun. There is nothing there, except for the filthy alleys and meager homes. Even if it is true that those launching the Qassams are taking advantage of these miserable children (which has yet to be proven), this should not shape our moral portrait. Yes, it is permissible to exercise restraint and caution. Yes, it is not always necessary to respond, especially when the response ends up killing children.

The way to stop the firing of Qassams is not through indiscriminate killing. Every launcher can be replaced. The start of the school year bodes ill, for us and for them. Anyone who truly seeks to stop the firing of Qassams should reach a cease-fire agreement with the current government in Gaza. That is the only way and it is possible. The liquidations, the shelling and the killing of children will work in exactly the opposite direction of what is intended. In the meantime, look what is happening to us and to our army.

Aussie Dave: Using Defamation Claim to Repress Blog Speech

Sunday, June 10th, 2007

Aussie Dave has written once more laying out some of his alleged legal claims against me. Seems he wants to charge me with defamation. I thought it would be worthwhile, if only for a primer in slander, libel and defamation law to examine his claims:

If I do sue you, it will have nothing to do with your political views – as heinous as I find them – and everything to do with defamation.

How about you run this past your lawyers?

“Which brings me to Johnson’s Little Green Footballs, a nominee in the Israel Advocacy category. How does a blog written by a non-Jew and non-Israeli get into a Jewish and Israeli Blogging Awards competition? I guess if you really stretch you could say that Charles always is looking to uphold the most extreme right wing viewpoints offered within Israeli politics. So perhaps that rates him an “honorary Israeli” designation. But seriously, one of the main reasons Charles gets nominated is that he in turn invited Aussie Dave to join him in Pajamas Media (see the latter’s profile). So it’s only natural that Dave would return the favor.”

Looks a lot like an unprivileged statement of fact that is harmful to my reputation, and published as a result of malice on your part.

Then there’s your false assertion I was booted from Pajamas Media.

And I haven’t even looked into the possible copyright violation yet, but it doesn’t really matter. You have repeatedly defamed me. And the onus would be on YOU to prove the truth of these statements, as a defence to a defamation claim. Which will be kind of hard to do, since they are utterly false to begin with.

I want a public, unqualified apology on this blog, with you acknowledging that you have no basis for making these statements.

As for the first claim that he wouldn’t be suing me for my “heinous” political views–let’s laugh that one off. Everyone knows that this is at the heart of his animus towards me.

The salient portion of his quotation from this blog post is this: “…One of the main reasons Charles gets nominated is that he in turn invited Aussie Dave to join him in Pajamas Media (see the latter’s profile). So it’s only natural that Dave would return the favor.” I made what I considered a reasonable inference based on a pattern of facts (i.e. LGF is run by a non-Jewish, non-Israeli author who nevertheless is nominated and wins the Jewish and Israeli Blog Awards). How else would you explain Charles Johnson’s presence in a competition dedicated in its title to groups of which he is not a member (i.e. Jewish/Israeli)?

As to whether or not Aussie Dave was “returning a favor,” let’s look at a not dissimilar situation. Marc Cooper was one of the few liberal bloggers included in PJM (he’s no longer affiliated). He edits LA Weekly (not sure if he’s still the editor). Michael Totten is one of the right of center bloggers at PJM. Marc blogs at PJM, Totten gets published at LA Weekly. Accident? I doubt it. Result of corrupt inside-dealings? No. But just the kind of internal back-scratching that goes on in these sorts of situations. It happens all the time. And hey, it’s entirely possible that Cooper actually likes Totten’s writing, though God only would know why he’d want to publish someone who largely cheers U.S. Mideast policy.

Instead of blaming me for pointing out something that many might find obvious, he should defend LGF’s inclusion in the award competition and tell everyone how proud he is of his buddy Chuck’s fine contribution to the Israeli-Palestinian debate & let it go at that. The fact that he doesn’t–that he makes a wild-eyed inflation of my claim by charging that I’ve called him “corrupt” says reams about his malice toward me.

The way I see it, Dave’s gonna have a hard row to hoe. He has to prove I claimed something was true while having “knowledge of falsity or with reckless disregard for the truth.” The fact that I believed what I said to be true about JIB is an awfully big legal hump to get over. Besides, I was expressing my opinion (strong, for sure) about the Awards and last I checked people were entitled to have opinons that differ with Dave’s. And by the way, if anyone goes back over our colloquy they will find that I made a number of comments which I believed in good faith but which Dave pointed out to me weren’t true. In the very few instances when that occured, I admitted as much here. So if I acted entirely out of malice, how do you explain that Dave?

Further, I’ve asked him to provide proof of his claim that he resigned from Pajamas Media and was not dropped. I’m willing to say what he said was true IF he presents the evidence. But he’s refused to do it here. You give a guy a chance to prove what he’s saying is true that would also show a small bit of good faith on my part and he refuses to give you the satisfaction. That’s Dave all over.

Further, my critique of the way he ran JIB claimed that the process was almost guaranteed, whether intentionally or not, to result in victory to right-wing blogs like LGF. And guess what happened? Those blogs did win. AD thinks I believe there was a blatant conspiracy to achieve such a result. I don’t believe that. But we all wear ideological blinders to a certain extent (Dave much more than others). The best of us try to transcend those preferences or prejudices we might have to embrace a more dispassionate view of the facts. But we all come with preconceived notions. My claim is that JIB, when he ran it, was replete with them and that this virtually guaranteed a certain outcome.

Now, the larger issue here is: can someone like me criticize someone like Aussie Dave without getting charged with a lawsuit? Can someone criticize the ideological leanings of a blogging contest without getting a lawsuit, or the threat of one, slapped on them? This gets at the issue of using blogs and the law as weapons of political intimidation. And it bleeds over into the issue I’ve made one of my mini-theses here: cyber-bullying.

Dave outghta get over this obsession he has with me as the bete noire of the Zionist left. So I said a few things about him that ticked him off. People write those sorts of comments at my blog all the time and I don’t turn around and threaten them with lawsuits. Do they piss me off? Sure. Do I respond strongly, even vehemently in my own defense. You bet. That’s part of the give and take of argument over the interet. But if I went after every person who ever said anything false about me I’d be in court till kingdom come and people could rightly accuse me of misusing both the courts and bullying my opponents–precisely what Aussie Dave and Rachel Neuwirth (and their allies Jewlicious and Steven Plaut) are doing.

Of course, I’m not counting people who post my images at their site to demean me, those folks I will pursue.

And as for that “public, unqualified apology” the bully’s looking for–in your dreams, in your dreams. I’m not Chaim Seidler Feller who provided Neuwirth a similar apology after four years of her legal intimidation. No sane person wants a lawsuit on their hands. I don’t relish spending a year or two fighting this one in court. But if I have to this is a helluva lot more worthy cause than Paris Hilton’s court appearances for her various improprieties.

Aussie Dave Threatens Tikun Olam With Lawsuit

Friday, June 8th, 2007

Now, we add Aussie Dave of Israellycool as a new honorary member of the right-wing pro-Israeli cyber-bully fraternity attempting to intimidate Tikun Olam with threats of lawsuits. Yesterday, Dave weighed in on my comment thread about an old incident that still rankles him. One thing led to another and before the night was out Aussie Dave had really worked himself into a lather. Looks like the guy really, really wants to sue me.

It goes back to a series of posts I wrote here attacking his administration of the Jewish and Israeli Blog Awards (JIB) nearly two years ago. I claimed then that the competition was structured either intentionally or unintentionally to guarantee that right-wing blogs like Little Green Footballs, Treppenwitz and several others would win in many categories (and guess what–they did!). I think I used the term “nepotism,” by which I meant that the Awards seemed like they were “all in the family” so that blogs reflecting Dave’s ideological viewpoint would be almost guaranteed to win. I complained there were few left of center blogs nominated. I complained that the Awards seems designed for pro-Israel boosterism. In my specific critique of the nominated right-wing blogs I included Israellycool and what I thought was a particularly condescending post Dave wrote defining what a “good Arab” is.

Dave, who is very thin-skinned and self-absorbed, accused me of calling him “corrupt” and a “racist.” We had a long, knock down drag out argument in which I explained that I never wrote the word “corrupt” and didn’t intend to claim that he had accepted money or conducted the Awards immorally as that word tends to connote. This didn’t satisfy Dave, of course. He has this habit of taking things you say and upping the rhetorical ante as lawyers tend to do. I accuse him of “nepotism.” To Dave, that becomes a charge of “corruption” despite my explicit denial that this is what I intended.

As for the “racist” claim, Dave doesn’t like most Arabs or Palestinians. Especially not ones resisting the Occupation. Dave doesn’t even oppose the killing of innocent civilians during targeted assassinations (“…this does not mean that I oppose all targeted killings where innocent people are inadvertently killed”). There are a few good Arabs for Dave. They’re the ones like Nona Darwish, Walid Shoebat and Tawfiq Hamad who attack their religion (or former religion) as corrupt and embrace Israel as a light unto the Middle East (“Yunis Owaidah [is] a PLO Arab who is proud of the fact that he “collaborates” with Israel”). You can call such an attitude toward Arabs whatever you like–extreme condescension, cultural arrogance, etc. But I’d call Dave an Islamophobe at the least. Some people might use a stronger word. And if you look at what I wrote in context, the owner of Jewlicious accused me in the comment thread of claiming Dave was a “raving genocidal racist.” I denied the first two words of that phrase, but not the last.

In writing this JIB series, I found a picture of Dave at the PJM site, where he was then affiliated as a resident blogger (he is no longer affiliated and claims that he resigned rather than was dismissed by PJM). As I periodically do with a relatively small minority of my posts, I displayed his image with one of my JIB posts. Dave told me in no uncertain terms that he didn’t like the caption. But he NEVER told me he owned copyright; NEVER told me to take it down; NEVER filed a DMCA or Cease and Desist order which provides legal notice that you wish someone to remove something that violates copyright. I assumed that PJM owned copyright to the image since I found it there. To be fair, Dave claims that he said at his site that he wanted the image taken down (though I’ve never seen the link). Why he would assume I would read it there is beyond me since I make it a point of never visiting his site unless I really have to do so. Besides, this would not constitute a fair notice of copyright infringment.

A month ago or so I challenged Dave and Jewlicious to disassociate themselves from Steven Plaut, who’d quoted their previous attacks on me at the fake blog Plaut created in my name. Dave, of course, dismissed my anger over Plaut’s defamation as trivial. Instead, Dave complained once again about the image (over 15 months AFTER the image went up at my site). I replied, if the picture bugs you so much why didn’t you ever ask me to take it down. He said, now that you mention it it does bug me and take it down or I’ll sue. I did take it down for a time. But his braying attitude annoyed me so, that I decided to obliterate his image and display a black space where his face had been, saying in the caption that the image didn’t refer to anyone mentioned in that post. This was lame and I shouldn’t have done that. I should’ve removed the image and left it at that as Dave demanded.

Now, there is no image at all displaying at that post. But again, until a few weeks ago Dave has never made any specific claim of copyright infringement either legally or otherwise. Now, he’s itching to sue me. And he reminds me how formidable an opponent he’s likely to be. Here are some of his promises/threats. They start at shouting level and get progressively shriller:

You said I was booted from PJM and this is a LIE!

What kind of person throws an allegation to the public, and then tells the subject “Prove otherwise.” And if that wasn’t bad enough (from moral, ethical, and halachic perspectives), you ban the subject so they can’t even prove otherwise (and I have email exchanges to prove otherwise which I will likely post on my blog to show what a liar you are).

By the way, I AM a lawyer and I am compiling some of your defamatory statements about me (incl. accusing me of being corrupt wrt the JIBs and making an agreement with LGF, accusing me of racism) which I will be reviewing. And don’t bother trying to change the offending entries…I have a nice catalogue of screenshots and archived posts.

I am seriously considering making an example out of you.

To which I replied:

I’ll post anything at my site that would prove what you said is true. I just won’t publish yr comments calling me a liar.

I can’t believe you’d do something as foolish as trying to take me to court. But it’s yr call. I have both a Seattle and Los Angeles law firm already representing me. A lawsuit would provide me with a great megaphone to both defend myself and let the larger world know about my blog.

His response:

Did you hear what I said? I AM a lawyer. I am glad you have a law firm representing you, since when sued, it is your right to have one. Just know that I am a very good lawyer, and will take you to court if I believe I have a good case, and will achieve my objectives.

To which I replied:

So you’re a lawyer. So you’re a very good lawyer (if you do say so yourself). You want me to shiver in fear? Forget about it. If you have a good case, then you go right ahead. I’ll be waiting. You can say anything you want in an e mail. A judge will hopefully hold you to a higher standard.

His final ‘bloodcurdling’ reply:

Don’t worry, I will.

As best I can see these would be his grounds, I displayed an image of him that he knew all along was on my blog; and it took him well over a year to request that I take it down, which it now is. I’m a lying hypocrite. I accused him of being “corrupt” (which I didn’t). And I called him a “racist.”

Some might see this as an attempt to punish me because I’ve written things about Aussie Dave he really, really doesn’t like. Some might see this as Dave’s attempt to squelch someone whose political views about the Israeli-Palestinian conflict are anathema to him. With three websites displaying infringing images of me and two threats of lawsuits, some might see this as a budding alliance of pro-Israel right-wingers like Rachel Neuwirth, Steven Plaut, Jewish Task Force, Masada2000 and Jewlicious out to “get” someone whose blog has needled them for far too long (in their minds). I’m the uppity Jewish nigger (remember that slightly chilling phrase: “I’m seriously considering making an example out of you?”). I’m the nail that sticks up from the board that needs to get a good hammering back into its proper place. Or as Jewlicious’ owner wrote so charmingly at his blog, I’m that “whiny bitch.”

A chilly wind is blowing in the Jewish blogosphere.

UPDATE: Since originally writing this post, I have learned that an anonymous party claims ownership of the fake blog referred to above, furthermore stating that Steven Plaut has not participated in its creation. A reporter tells me Plaut has denied his involvement. So while I have no idea whether the anonymous party is being truthful, it is possible that Plaut is either not involved in the blog, is partially involved, or that the blog claimant is lying and Plaut is fully responsible. I don’t yet know for sure which is the case. My impression of Plaut’s authorship was based on the firm conviction of another victim of a very similar fake blog that Plaut was responsible.

Jewish and Israeli Blog Awards (JIB) Voting Open

Wednesday, April 25th, 2007

Yesterday, I voted at the Jewish and Israeli Blog Awards site for my favorite progressive Jewish blogs in the annual blog competition. Earlier in the week I’d nominated some of them when I noticed that no one else had: Mondoweiss, OCCUPIED and Sholem Zachary Berger among them. To tell you the truth, this is a skewed competition toward the Jewish right. Unfortunately, most Jewish blogs, as Mobius notes at Jewschool, are far to the right of mainstream Jewish opinion which is quite liberal:

I get riled up because I have a hard time accepting that the Jewish community – which is primarily liberal and progressive – should appear to be so overrepresented by the religious right… The domination of the blogosphere by the Jewish right is a stain on our community and reflects poorly on us internally and externally.’

…My goal…[i]s to help foster a larger, stronger left-wing Jewish blogosphere

He is more pleased with the diversity of this year’s JIBs:

Last year, there were only six politically left-wing blogs nominated throughout the entire JIBs contest, three of which were my own, and one of which was a Jewschool contributor’s blog. I’m very pleased to say that this year, there are 18 blogs nominated in the left-wing politics category alone (in fact, this is the first year a left-wing category was merited)…

While I agree that the competiton has improved markedly, you can still see where left and right wing blogs compete in the same category that the right wing blogs generally gain more votes. That being said, JIB is the best that we currently have and I think it’s worth trying to bend the flow of the river a bit in our direction.

The JIB site doesn’t make it easy to vote in an organized, methodical way. You have to carefully navigate your way through scores of blog choices in multiple entries. But be patient and take your time.

I encourage you to vote in the JIBs. And not just to vote for me or other progressive bloggers, but check out other blogs whose names sound interesting. Widen your world.

I wasn’t sure how gung ho I wanted to be about JIB but this snarky comment from the hardline rightist pro-Israel Soccer Dad published at my ‘old friend’ Aussie Dave’s Israellycool blog (where I’m now officially know as “Nasty Jewish Lefty blogger“) spurred me to promote both JIB and my own blogs’s participation:

And the votes keep rolling in for Tikun Olam. He must be getting stronger, he’s disappeared!

Apparently, he can’t count as Tikun Olam has received 11 votes out of 221 cast thus far in the News/Current Events blog category. And that’s before I’ve even suggested that any of my readers head on over there to vote. It’s Soccer Dad’s generosity of spirit I most appreciate, you know? And I do like being Aussie Dave’s bete noire. I take it as a badge of honor. Too bad you can’t vote AGAINST certain blogs!
